Eight immigrants in US custody have lost their final attempt at avoiding deportation into South Sudan, facing continued criticism of human rights abuses.
On Friday, Boston Judge Brian Murphy denied the 11-hour appeal.
The appeal argued that repeated efforts to expel men to South Sudan under President Donald Trump were “unacceptably punitive.” It pointed out that the US Constitution prohibits “cruel and extraordinary punishment.”
In the past, the US State Department has denounced South Sudan for “counts of extrajudicial killing, loss of enforcement, torture, cruel, inhuman, degraded treatment or punishment.” Due to the ongoing armed conflict, American citizens do not recommend traveling there.
However, the US Supreme Court has twice ruled that the Trump administration can actually expel men outside of their home country. That latest decision was issued Thursday.
The U.S. Department of Justice indicated on Friday that eight men were set to fly to South Sudan by 23:00 GMT. They were welcomed by countries such as Cuba, Laos, Mexico, Myanmar, Sudan, and Vietnam.
The final appeal of the groove was filed Thursday night shortly after the Supreme Court handed its decision.
Initially, the case was assigned to District Judge Randolph Moss in Washington, DC, who showed sympathy for Decorty’s request.
He ordered a brief deportation to be suspended until 4:30pm (20:30 GMT), but in the end he decided to return the case to Murphy.
Murphy had previously issued an injunction against deportation into South Sudan, leading to a successful appeal from the Trump administration. Meanwhile, eight men were detained at a military base in Djibouti, but the court decided their fate.
But before he returned the case to Murphy, Judge Moss said Denner could prove their case that the Trump administration intended to abuse them.
“It seems almost self-evident to me that the US government cannot take humans and send them to situations where physical health simply punishes them or risks signaling others,” Moss said at the hearing.
Meanwhile, lawyers for the Trump administration argued that the continued delay in deportation would strain relations with countries that are willing to accept immigration from other countries.
Murphy, who denied Friday’s request, previously agreed with Decorty, issued an injunction for removal to South Sudan, and said he had the right to challenge deportation based on fear of safety.
The Supreme Court first lifted the injunction on June 23, and once again made it clear on Thursday, giving Judge Murphy a subtle responsibilities.
The Trump administration has pushed for rapid removal as part of a campaign to expel the mass expulsion, one of Trump’s signature priorities.
Opponents accused them of steaming undocumented human rights of people to achieve their objectives, including legitimate processes.
However, the Trump administration has framed undocumented migration as the “aggression” that constitutes the national security crisis, and has argued that its strong armed efforts are needed to expel criminals.
The eight migrants are scheduled to be sent to South Sudan and described them as “wild, violent, criminally illegal aliens.” It added that they were found guilty of crimes that included first-degree murder, robbery and sexual assault.
“These siccos will be in South Sudan by Independence Day,” Homeland Security spokesman Tricia McLaughlin said in a news release Thursday.
